The Nevada Update

Since I am receiving a lot of emails asking about Nevada, here is the latest. Governor Jim Gibbons has called legislators in for a special session which is scheduled to begin next week. In his proclamation ordering legislators to report he instructed legislators to examine several measures to address the budget deficit facing Nevada.

In addition to reducing spending, there are of course provisions to increase revenue. One of the revenue measures includes examining enacting new nexus definitions and regulations to require some out of state merchants to collect and remit sales and use tax  on sales to Nevada residents.

The opinion on whether Nevada Internet sales tax will move forward in Nevada is mixed. Some feel the strong anti-new tax stance of legislators may prevent passage. Others feel that the ever growing budget deficit will prompt legislators to pass legislation to” recover what they should be collecting”.

As is the case in every state with a sales and use tax, affiliates should first and foremost prepare their business model to protect their income. This means finding replacement merchants in case they are needed. Not every merchant will terminate affiliates. There is time to prepare.

If possible, get involved by attending public hearings or contacting your representatives.  Affiliate Advocacy is monitoring all the states and helping affiliates in every state as they deal with the pending legislation.
