Nexus Legislation Updates

The following list is by no means a complete list of nexus legislation activity. Several other states are rumored to be discussing adding Internet Sales Tax legislation bills, either as a stand alone bill or as part of a more encompassing omnibus tax bill. We will continue to monitor these bills as well as all the action in several other at risk states. As you are hopefully aware, any state with a sales and use tax can introduce legislation at almost any time.

Nexus Legislation Awaiting Governor:

  • Colorado HB1193was approved by both Senate and Assembly with the final concurrence on 2/16. The Governor has 10 days to sign or veto; if he takes no action it becomes law automatically. Internet sales tax takes effect on March 1, 2010.   Merchants are urged to seek professional counsel regarding the impact of this law on their business.   Link to HB 1193 Colorado Internet Sales Tax.  A brief summary of this bill is that merchants may need to collect sales tax in Colorado; those not collecting it may need to send a yearly statement to Colorado residents who made a purchase indicating they need to pay a sales and use tax.

Pending  Nexus Legislation

California – ABX8-8 was approved by the Senate last week and now heads back to the Assembly for a vote today (2/23) . ABX8-8 has, among other provisions, the California Internet Sales Tax legislation. Update 2/23 Assembly moved to send to Rules Committee.

Illinois SB3353 – The bill for Illinois Internet Sales Tax had its First Reading on February 10, 2010 and was referred to Assignments.  Other Committees are meeting on February 23 to discuss the budget deficits.

Maryland SB824 – First Reading of the Maryland Internet sales tax bill was on February 10, 2010 and referred to Budget and Taxation Committee. Note:  Joint Budget Committees are also currently meeting. Reference also made to last years bill, a fact which may simplify legislators vote.

Mississippi SB 2927 – Legislation for Mississippi Internet sales tax is apparently dead in committee. Note, they are still working on the 2010 Legislative Budget so this process still needs to be monitored.

Nevada (No bill number) – Legislators have been ordered by Governor to meet. He has instructed them to examine the nexus issues and to introduce  Nevada Internet Sales Tax legislation.  They will be meeting this week.

Oklahoma (No bill number) - Governor has included Internet sales tax in his budget. Legislation expected to be introduced. Need to watch different avenues for introduction.

New Mexico  HB 50 – Apparently tabled and no further action will be taken. Again as mentioned above, budget bills and emergency sessions need to be monitored. 

Vermont HB 661 – Will be discussed in committee session on Tuesday, February 23.

Virginia HB 660 Passed the Senate by overwhelming vote of 28-12. Moved to House, passed first reading and referred to Finance Sub Committee 2; will be heard in committee Wednesday, February 24
