In Connecticut, HB 5481 was filed with Legislative Commissioner’s Office (LCO) on March 26. The LCO checked it for constitutionality and then sent it to the Office of Fiscal Analysis who will determine any costs involved with implementation. Then, the Office of Legislative Research adds the plain English explanation of the bill . The bill then gets assigned a calendar number and is sent to House for a vote.
In Illinois, SB 3353, which had been in the Revenue Committee, held public hearings, was held over and then sent back to Assignments. This bill may or may not be sent back to the Revenue committee (or another committee) for further debate this year.
Down in Florida, the bill for Internet sales tax and iSTART is gaining momentum. The bill is currently in Policy Council for review. It would be a good idea to familiarize yourself with the action in Florida. While it may not an “Affiliate tax”, this bill if it passes may have an impact on our industry. In Maryland, SB 824 is still in committee after public hearings were held. opinions are mixed as to whether this bill will move forward.
We have been waiting for Tennessee to revisit their Internet Sales tax bill. They have resurrected HB1947 (companion bill is SB1741) If you recall this bill had some support but the anticipated revenue was found to be insignificant.
Georgia (along with a few other states) is working on some of the changes necessary to implement and comply with the Streamlined Sales Tax Project, but has not yet introduced “Amazon tax” or Internet sales tax.
We are also still waiting to see if California introduces a new bill. Other states are also at high risk and we continue to monitor.
